By placing your ORDER you expressly agree to the terms and conditions set forth on this schedule. If you do not agree to these terms and conditions, do not submit your order. Customers must be in good standing with America's Hobby Store (formerly Trans-Global Hobby Shop) when orders are placed.

All of your information is safe and secure. America's Hobby Store does NOT give your information to ANYONE -- EVER.

CVV2 CODE: The CVV2 code is a three digit code on the back of your credit card on the right side (located on the signature strip). Amex credit cards are 4 digits on the front of the card. If you need help finding the CVV2 code, please call or email us and we will be happy to assist. No credit card orders will be processed without the CVV2 code per our credit card processor. This requirement is the credit card companies' policy, not America's Hobby Store.

Method of Payment: We accept Visa, Check Cards, MasterCard, American Express and Discover Credit Cards and PayPal. We also accept Cashier's Checks and Money Orders made payable to America's Hobby Store. We accept personal checks (no checks on banks outside the United States), but please note that we will wait 7-10 working days for the check to clear before we will ship the goods that you have ordered. There is a fee for returned checks which is the maximum amount allowed by your state.

A. America's Hobby Store will invoice and bill the Customers' credit card at time of shipment except for cash deposits covered below and for unique situations such as cars or sets that require the free wheel exchange program from Marklin. For the free wheel exchange program we will charge your credit card at the time of order and if you cancel your order, 35% of the price of the item that you cancelled is non-refundable due to re-stocking fees. There is an $11.00 additional fee for participating in the Free Wheel Exchange Program of which no discounts can be applied to this fee. This is in addition to the normal shipping charge.

B. America's Hobby Store may ship orders as goods become available or America's Hobby Store may hold items until a reasonable group of stock or all the order is ready to be shipped. Partial orders may be shipped and the customer will be billed and pay shipping costs for every shipment.

C. All orders will be paid for in full before items are shipped. We reserve the right to charge the Customer's credit card when the manufacturer ships the merchandise to America's Hobby Store.

D. America's Hobby Store accepts U.S. Dollars ONLY. America's Hobby Store may require a cash deposit for certain items at the time of order placement of which 35% of the total customer cost of the item is non-refundable. If the credit card has already been charged, it may take 2 business days to refund the money to Visa, MasterCard and Discover. It may take up to 4 business days to refund money to an American Express account.

E. If the Customer lives in Alabama, America's Hobby Store will bill the customer for a tax of 5.5%. No discounts will be applied to tax. All discounts are calculated before taxes are figured.

F. If the state that you live in (other than Alabama) imposes any internet sales taxes, or any other tax, the Customer will be responsible for paying any said taxes. America's Hobby Store is not responsible in any way for paying or collecting any taxes except for the State of Alabama and Madison County Alabama.

G. If Items are listed on the web site for .01 or .02 it does not mean that the item costs .01 or .02. It simply means that we do not have a price from the manufacturer or distributor at the present time and that is the only way the shopping cart could process the item. We consider this a reservation and when we receive the pricing and present it to you, you may cancel within 3 days with no penalties at all. We will provide pricing as soon as it is available to us.

A. We charge $11.00 for shipping to any location in the continental United States for United States Postal Service Priority Mail for all orders. International customers should ask us how much shipping will be to your country. Any other service or speed of delivery will incur additional charges.

B. If the Customer requests that the order be split into multiple shipments, there will be additional shipping charges applied.

C. Add $11.00 for each additional shipping address on your total order after the first shipping charge.

D. We reserve the right to change prices on this web site at any time without notice.

F. For International first time customers (or the first time use of a new/different credit card to America's Hobby Store) we will charge the Customer's credit card 1/3 of the value of the order at the time the order is placed. International Shipments are shipped and invoiced based on United States Postal Service (USPS) Rates. If the Customer requests USPS or another carrier other than USPS, then the Customer will be billed and is responsible for all additional costs incurred by the service in which they select. See USPS for estimate of rates -- the origin (ship from) zip code is 35810. Shipping charges may appear as a second unique charge on your credit card at the time of shipment. America's Hobby Store may add USD $15.00 for the customer's bank approval charges and our extra work on all international shipments, or just on the first order, or for the first time a different (or unique to America's Hobby Store) credit card is used. The customer is responsible for all import taxes and or duties imposed on shipment. If a customer rejects the shipment for any reason when the carrier is trying to deliver the package, America's Hobby Store is then cut out of the loop and America's Hobby Store can not do anything to help the customer get their package. When the Customer rejects the shipment, from that point in time forward, America's Hobby Store is NOT responsible for the package in any way. It is then between the customer and the shipping agency.

G. International Orders can not be shipped to alternate shipping addresses unless setup before the order is placed or special provisions are made directly with America's Hobby Store. International orders will be shipped to the billing address only. America's Hobby Store will not ship to Indonesia, Taiwan, or certain other foreign countries without providing certain data in advance of placing the order, such as: Name of Individual, Billing Address of Credit Card, Name of Bank Credit Card is issued under, Address of Bank, Phone number and Fax number of Bank. All International orders must be pre-approved before the actual order is placed. If you are using PayPal, you must be a Verified Customer and the address must be verified. If you are using PayPal, and it is your first purchase from us, we will only ship to the address listed on PayPal.

III. RETURNS:

A. Merchandise purchased from America's Hobby Store may be returned for store credit or equal exchange only. Items can ONLY be returned within 30 days and have to be in the same exact condition as you received it. It must contain all instructions, extra items, plastic, foam and anything else originally included in the box. A 10% restocking fee will apply to all returns except for warranty returns. NO CASH REFUNDS. NO CREDIT CARD REFUNDS. All returns are subject to management approval. The Customer is responsible on all shipping and handling costs for non-warranty returns. If signs of abuse or neglect of the part or unit are visible, then the manufacturer will not cover a warranty repair and the Customer is responsible for all repair costs. America's Hobby Store reserves the right to verify claim for validity of defective part. The Warranty period for Marklin is two years from the date of purchase for Factory New Items. When items are sold as used or "as is", then no warranty applies and items must be returned in 7 days after receipt of the item (for store credit only as stated on this page). No returns will be accepted without an RMA number that you must acquire from America's Hobby Store prior to shipping the returning item.

IV. BACKORDERS/OTHER

A. We do not guarantee Stock. The presence or absence of part numbers and/or pictures on our web site do not qualify the existence of stock for America's Hobby Store or any manufacturer or distributor. Quantities are limited and we reserve the right to limit quantities per item sold to a single Customer from our Specials or any other item that we sell.

B. If an item is not available and is backordered, America's Hobby Store will bill and ship the item when it becomes available without further contact with the customer, unless the customer requests contact before shipment.

C. Customers may cancel "Backordered" Items or any un-shipped Orders at no cost, prior to shipping with the exception of special order items such as Insider orders or other special orders. When Items are sourced through other dealers or distributors, the order can only be canceled with a 35% re-stocking fee.

D. America's Hobby Store reserves the right to cancel any open order at any time or modify quantities.

E. If you email America's Hobby Store or Send America's Hobby Store an order, America's Hobby Store then reserves the right to send you emails in the future. We only send about one email a month. If you do not want emails sent from America's Hobby Store, then you are responsible for informing America's Hobby Store that you do not want to be on our email list either by email or phone.

F. If you pay via PayPal and the items are not in stock or have not been delivered to the United States yet, we consider the item paid for and we will automatically ship the items when they arrive. If you want to cancel your order after the PayPal transaction is performed, we may charge you a 35% restocking fee and then refund the remaining money to PayPal.

Fraud on the internet is a Federal Offense and The FBI Actively Investigates and Prosecutes Internet Fraud. If a Customer Presents a Credit Card That is Stolen Or That The Customer Does Not Have Permission to Charge Items To (Fraud), Trans-Global Technologies, Inc. Will Prosecute To The Fullest Extent Of The Law.
